Preamble:
The occupation of Palestine, the usurpation of its land, the killing and displacement of its people, and the Judaization of its sacred sites by the Zionist occupation, in collusion with colonial and imperial powers, represent one of the greatest crimes in human history whose repercussions continue to govern the trajectory of global events and developments today, making the Palestinian cause a central issue in the struggle for freedom and a key entry point in humanity's pursuit of justice.
“The cause of Palestine is a national cause”—this slogan was and still is entrenched in the consciousness of the Moroccan people in all its spectrum and components in renewed continuity of the depth of the civilization relationship that ties it to Palestine as a land, people, [and their] sacred sites. Moroccans have not ceased drawing the world's attention with their unwavering stance in defending the Palestinian cause and supporting the struggle of its people against Israeli occupation.
If the embrace of the Palestinian resistance stems from the authenticity of the Moroccan people's human, national, and religious positions, opposing the Israeli entity and confronting the steps towards and designs of normalization has been central to the activism of the Moroccan people and their stance on the nature of this entity.
The Israeli entity, given its natural expansionist and settler colonialist birth founded on the usurpation of the land Palestine and on the commission of continuous crimes against humanity, its systematic Judaization of Islamic and Christian holy sites in Palestine, and the enforced displacement of millions of refugees and displaced people… It is a criminal, racist, and terrorist entity whose existence and continuation is nurtured by colonial policies through political, military, and economic backing. Normalization with it is the most important confluence to provide it with the means of survival, expansion, and hegemony over the peoples and resources of the region.
The Zionist machine, along with the U.S. administration and officials from several Western countries, is actively working to legitimize the existence of the Israeli entity and entrench its crimes. They exert various forms of pressure to impose normalization, using various mechanisms (such as Mediterranean, Euro-Mediterranean, and Middle Eastern initiatives, among others) and using tortuous and deceptive means, ranging from “cultural initiatives” alongside artistic, scientific, athletic, and media fields under the pretext that these fields are unrelated to politics. This also extends to tourism and economic activities, including the marketing of Zionist products disguised after their packaging in other countries, to the extent interaction with it is increasingly shifting toward direct exchanges, all as part of a broader plan to make normalization encompass all aspects of life.
These designs, among others, are heavily funded because of the Zionist project’s desperate need for normalization, which is being promoted under the guise of humanitarian, artistic, spiritual, “interfaith dialogue,” and other such scenarios.
Normalization means recognizing the “legitimacy” of this entity and its crimes, thus eliminating and nullifying the Palestinian right to liberation and return, in defiance of international laws and conventions. From this perspective, normalization is not only complicity in the crime of occupying Palestinian and regional lands but also constitutes an original crime based on a deliberate act that acknowledges and accepts all the crimes on which this terrorist, racist entity was founded and continues to commit publicly and daily. It also represents support for these crimes and an attempt to legitimize them, amounting to glorifying terrorism and terrorists, which is a punishable crime under Moroccan criminal law.
Normalization with the Israeli entity is not only a crime against Palestine but also a crime against the Moroccan people, who have suffered from the occupation's terrorist crimes, including the destruction of Moroccan endowments in Palestine, most notably the “Moroccan Quarter” in Jerusalem, under whose rubble were killed many descendants of Moroccans who had lived in Jerusalem since ancient times. The occupation has also killed many Moroccan nationals throughout the years of the national liberation struggle in Palestine since its usurpation in 1948 to the present day.
The Israeli entity is not content with occupying Palestine and the lands of other peoples in the region, but it infiltrated and still infiltrates, through normalization channels and collaborators, the social fabric of the peoples, undermining cultural, ethnic, and sectarian bonds to exploit them as part of the so-called “creative chaos” aimed at fragmenting the region, monopolizing its resources, and suppressing all attempts at revival.
The reality of occupation is unchanging, as is the reality of racism and terrorism. Therefore, any normalization with Zionists or the Israeli entity constitutes support for the occupation and collaboration with the occupier.
Resisting the Zionist project, along with all colonial projects in the region, cannot continue and succeed in achieving its goals of liberating Palestine and the nation without ensuring the safety of the rear defense stop line from the danger of Zionist infiltration, with normalization being its primary tool in various fields: politics, economy, culture, media, sports, arts, cinema, and so on.
Given the Moroccan people’s deep and principled involvement in the Palestinian people's liberation struggle and opposition to occupation and considering the repeated and serious Zionist attempts to penetrate the Moroccan sphere through multifaceted and multi-level normalization efforts, both secret and public, the grave danger of normalization with the Israeli entity and Israelis in Morocco has become increasingly apparent. Normalization targets the national social fabric by attempting to infiltrate its essential components and cultural structures. Therefore, there is an urgent need to issue a law that criminalizes normalization with the Israeli entity and Israelis and puts an end to this heinous crime.
Article 1: Normalization with the Israeli entity is considered a punishable act, including the commission, contribution to, participation in, or attempt to commit the following actions:
1. Conducting any commercial transactions as defined by the Moroccan Commercial Code with the Israeli entity, whether:
- Undertaken by a natural or moral person residing in Morocco or by a Moroccan person, natural or moral, residing outside Morocco.
- The person normalized with, whether Israeli or residing in the Israeli entity, is a natural or moral person under the purview public or private law.
- The transaction is incidental or recurring, direct, or through mediation.
2. Any financial transactions with the Israeli entity as defined in clause 1 of this article, including banking and insurance transactions as regulated by laws, decrees, and decisions that regulate it in Morocco.
3. Any professional or artisanal services conducted with the Israeli entity as defined in clause 1, whether compensated or provided free of charge.
4. All types of activities conducted in the Israeli entity to which natural or legal persons residing in Morocco contribute, participate, or attend, whether the activities are of a political, economic, cultural, artistic, sports, or other nature, and whether organized by official or non-official parties.
5. All types of activities conducted in Morocco to which natural or legal persons holding Israeli citizenship or residing in the Israeli entity contribute, participate, or attend, whether the activities are of a political, economic, cultural, artistic, sports, or other nature.
6. All types of cooperation or exchanges with the Israeli entity, whether permanent or incidental, in any field whether political, economic, commercial, financial, cultural, sports, artistic, tourism, or media, whether the parties involved are natural or moral persons under public or private law holding Moroccan citizenship or residing in Morocco, and whether the cooperation is direct or through mediation.
Article 2: For the purposes of this law:
- Anyone who meets the criteria of Article 128 of the Moroccan Penal Code is considered a contributor to normalization with the Israeli entity.
- Anyone who meets the criteria of Article 129 of the Moroccan Penal Code is considered a participant in normalization with the Israeli entity.
- Anyone who meets the criteria of Article 114 of the Moroccan Penal Code is considered someone who attempts to commit the crime of normalization with the Israeli entity.
Article 3:
Anyone who contributes to or participates in committing acts of normalization with the Israeli entity, or attempts to commit them, shall be punished by imprisonment for period ranging from two to five years and a fine ranging from one hundred thousand to one million dirhams.
The court may also, in addition to the primary penalty mentioned in the first paragraph of this article, impose one of the additional penalties stipulated in Article 36 of the Penal Code.
Article 4:
The provisions of this law apply to anyone who has chosen Israeli citizenship.
Article 5:
This law shall take effect from the date of its publication in the Official Bulletin.
